Terms of Service
These terms govern your use of ponchobymammy.com and any purchase you make from us. By placing an order you agree to these terms.
1. Who we are
Poncho by Mammy is a small handmade kids-clothing brand based in London, United Kingdom. You can reach us at foryout99@gmail.com.
2. The contract
A contract between you and us is formed when we send you an order confirmation email after a successful payment. Until that email is sent, we may decline an order — for example if a product is out of stock, the price is wrong, or we suspect fraud. If we decline, we refund any payment in full.
3. Prices
All prices are shown in pounds sterling (GBP) and include any UK VAT where applicable. Delivery is charged separately and shown at checkout before you pay.
We try to keep prices accurate but errors happen. If we discover a clear pricing error after you order, we will contact you and offer a refund or the chance to confirm at the correct price.
4. Payment
Payments are processed by Stripe. We accept the cards Stripe supports (Visa, Mastercard, Amex, Apple Pay, Google Pay). We do not store your card details.
5. Delivery
See our Shipping page for current rates and timeframes. Risk in the goods passes to you when the courier delivers them to the address you provided.
6. Returns and your right to cancel
Under UK Consumer Contracts Regulations you have 14 days from the day you receive the goods to cancel and return them for a refund, without giving a reason. Full details — including how to return — are in our Returns Policy.
Your statutory rights under the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose and as described) are not affected.
7. Care
Each product comes with a care label. We are not responsible for damage caused by failure to follow it (e.g. tumble-drying on high heat when the label says low).
8. Account
If you create an account, keep your password safe. You are responsible for actions taken via your account. Tell us straight away if you suspect unauthorised access.
9. Acceptable use
You agree not to:
- Use the site to break the law or someone else's rights;
- Attempt to break, probe or overload the site;
- Submit false, abusive or spam content (including in availability requests).
10. Our liability
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be excluded under English law. Subject to that, our total liability for any claim arising from an order is limited to the amount you paid for that order.
11. Intellectual property
All photography, copy, designs and the "Poncho by Mammy" name are ours (or used under licence). You may not copy or republish them without our written permission.
12. Changes
We may update these terms from time to time. Orders are governed by the version of the terms in force when you placed the order.
13. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. Nothing here removes your rights as a consumer where you live.
14. Online dispute resolution
If we cannot resolve a complaint, EU/UK consumers can use the European Commission's ODR platform at ec.europa.eu/consumers/odr.
